Reasons For Creating a Trust
The trust concept has been in existence for many centuries. As far back as the tenth and eleventh centuries trusts were being used by those fighting in the Crusades as a method of ensuring their hard-earned wealth was protected. They achieved this be placing the management of their assets in the hands of trusted associates. Today the use of trusts has been extended to deal with a wide range of financial and legal situations.
A Trust is defined as an arrangement recognised in law when an individual (the settlor) transfers certain assets (the trust fund) to an individual or company (the trustees) to hold in its name for the benefit of other persons (the beneficiaries) on certain terms and conditions set out in a Trust Deed.
The assets making up the trust fund are legally held and registered in the name of the trustees who are under a duty enforceable in the courts to hold the assets and the income arising from them for the benefit of the beneficiaries.
The transfer of assets to the trust and the resultant change of ownership have numerous benefits and it can provide effective and efficient protection of the assets placed in trust against many varied concerns.
Trusts can also be used effectively as part of a strategy for tax and estate planning.
There are many varieties of trusts. A trust can be revocable or irrevocable, formed with or without a protector formed by declaration or deed of settlement in long form short form simple or complex discretionary fixed or settlor directed. The purpose of the trust will often dictate the type of trust formed.
